We regularly consult with specialists and expert medical witnesses to better understand our clients' complex injuries. This helps us not only prove causation on injuries that may not be diagnosed for years, but also helps us prove who is liable for what injuries when there have been multiple traumas, for example months or longer apart, and when there are preexisting conditions.
We also work with experts in the areas of property damage, bio-mechanical engineering, and accident reconstruction to explain injuries and liability questioned by the defense. For example, when there is data in a car's black box Event Data Recorder (EDR) that can be used to prove liability, we send an engineer to download this data and then our accident reconstructionist, working with our property damage expert and biomechanical engineer, recreates the collision to prove injuries and liability.
Mr. Baker has published and taught courses on the intersection of property damage and traumatic injury. For example, when there is significant injury caused by insignificant reported damage, there is often one of two things: (a) significant unreported damage, or (b) a 1/4" solid steel trailer hitch bolted or welded directly to the frame that can take a massive hit and show almost no damage. We use this expertise to overcome the "no mechanism of injury" defense raised by the defense, which also gets raised by PIP carriers in their attempt to improperly deny medical bills.
